Conrad Murray Not Expected To Serve Full Four Years

Legal expert Mike Cavalluzzi tells MTV News he isn't surprised by sentence but doesn't think it's justified.

Though he dodged a potential four-year prison term, former Michael Jackson physician Conrad Murray was sentenced to an equal amount of time in Los Angeles County Jail on Tuesday (November 29) in the death of the pop singer.

But the same overcrowding problems that spared the cardiologist from doing time in a federal pen might also save him from serving his entire sentence in county as well. Shortly after the sentence was handed down by Los Angeles Superior Court Judge Michael Pastor, Los Angeles Sheriff spokesman Steve Whitmore told E! News that Murray would likely end up serving "a little less than two years." Due to overcrowding, most county jail sentences are immediately cut in half, and given the 46 days credit Murray has already been given, he is looking at even less than that.

Murray's lawyers said afterward that they believed the sentence was unnecessarily long. "Yes, of course [Judge Pastor] was harsh. He gave the stiffest penalty he was entitled to give under the law," Murray's attorney, J. Michael Flanagan, told reporters. "He was openly hostile. ... [Murray has] led 56 years of exemplary life. He was really dreading [sentencing]. I think anybody would dread going into it. He's an honorable man, and he'll get through this. The family is suffering more than Dr. Murray is. ... Dr. Murray is the provider in that family."

Pastor had leeway in the sentencing, with options ranging from probation to the full sentence, but in a lengthy ruling from the bench, he said Murray's lack of remorse and negligent behavior called for the highest possible penalty. "He is and remains dangerous ... the request of probation is denied, the court imposes the high term of four years imprisonment in this case," Pastor said during the 90-plus-minute hearing.

Los Angeles-based criminal defense attorney Mike Cavalluzzi told MTV News that he wasn't surprised by the sentencing but that he didn't believe it was justified. Cavalluzzi said Pastor had incentive to give the full sentence because of the prominence of Jackson and his family and to create the perception that he is tough on crime. "He gets that perception by sentencing him to the max while not having to surrender the defendant to the full sentence," said Cavalluzzi, who was not involved in the case. "He gets the self-satisfaction of being perceived as being tough on crime and making the Jackson family happy, but I don't think it was a fair sentence."

Cavalluzzi said when deciding prison versus probation, judges have to look at someone's criminal history and whether a person is likely to complete the terms of their probation, which he believes Murray would. "I'm not seeing aggravating factors here, and I think it was just a chapter in [Murray's] life and he does not have a history of being a mercenary doctor always after money, but of being a good, responsible doctor who was seduced by the celebrity and money that Jackson offered," he said.

As to why Pastor gave such a dramatic, lengthy explanation for why he was sentencing Murray to the max, Cavalluzzi said the judge has to have a justification for his actions in the public record. "Because he doesn't have the discretion to give a high prison term, [Pastor] has to justify his sentence in the record and have very specific reasons for it. I don't think there's any way that anyone truly believes that from this day forward Dr. Murray truly represents a threat to society. That's just ludicrous."

And while he doesn't agree with the four-year term, Cavalluzzi said the high-profile nature of the case and the glare of the media could have played into the sentence. "It probably gives [Jackson's family] great comfort to have someone to blame," he said. " 'If not for this awful man, my son, brother, father would be alive.' But it's not fair to do that and it feels like a capitulating judgment in favor of feeding the emotional needs of the family."

Upon leaving the courthouse, Michael's brother Jermaine, when asked if the four-year sentence was enough, shook his head and said, "No." Mother Katherine Jackson told local TV station KTLA, "Four years is not enough for someone's life. It won't bring him back. But at least he got the maximum, and I thought the judge was very, very fair."

The prosecution, however, was satisfied with the ruling.

"We're pleased. That's what we thought was appropriate. The judge obviously agreed with us," deputy district attorney David Walgren said. "It was our position that it was not a simple, one-time mistake; it was a series of mistakes culminating in the abandonment of Michael Jackson when he died ... the judge agreed with that sentiment. A brother and a son and a family member was killed, and whatever the sentence may be, the family of the victim deserves justice. And we did everything to bring them that justice."

As for how much time Murray will spend locked up, Cavalluzzi said it is likely to be less than two years and, frankly, he predicted, the doctor could be out even sooner than that. "He might be eligible for house arrest very quickly," he said.

'Hugo' Director Martin Scorsese Speaks On His Productivity, Legacy

'One tries to do the best you can with each picture, hopefully continue making them,' renowned filmmaker tells us.

Martin Scorsese's career is one of such significance and acclaim that the Oscar-winning director could retire from the business right now, knowing that his living-legend status would remain intact. It is clear he has no plans to slow down, however, due to the fact that in the last year alone, he's been involved in five feature film and documentary projects, the most recent being his first family-oriented film, the critically acclaimed "Hugo."

When MTV News caught up with Scorsese recently, we asked him to explain the secrets behind his productivity. "There seems to be a sort of urgency, an interest in making comments on certain aspects of life and the world around me, the people, culture today," Scorsese said when asked if he's working under his own self-imposed deadlines or urgency to complete projects. "Whether it's trying to deal with how art inspires a young person — and that is 'A Letter to Elia' — or trying to create a spectacle of American enterprise and corruption as [with] Terry Winter and his show that I'm working on with him, 'Boardwalk Empire,' or people speaking their minds and very strong opinions, like Fran Lebowitz in 'Public Speaking,' but even more so was working for five or six years on 'George Harrison: Living in the Material World,' with David Tedeschi. That is interesting because that was finished at the same time as 'Hugo.' Those five projects were finally released all within one year."

We then asked if with this sudden urgency, Scorsese is conscious or concerned with preserving his legacy as a filmmaker.

"Not really, maybe I [was] at one point," he admitted. "I'm not quite sure anymore. I don't really know. I think at one point in the early '90s, there seemed to be a lot of films being made here in America and in China and around the world that had been inspired by 'Mean Streets' ... that may still be the case that may not be the case, I don't know anymore. One tries not to think of that. One tries to do the best you can with each picture, hopefully continue making them and that they mean something, that they matter to people."

While another English songstress has received a tremendous amount of well-deserved praise here in the States this year, Ellie Goulding has been working slowly but steadily, making a name for herself on this side of the Atlantic. Her debut album, Lights, hit #1 on the U.K. charts, she won Critic's Choice at the 2010 BRIT Awards, and she's even had the opportunity to perform at the Royal Wedding reception for Prince William and Catherine Middleton.

Of course, Americans don't really care about any of that. They do, however, really like Christmas. Goulding is set to perform at the White House during the National Christmas Tree Lighting Ceremony, along with will.i.am, Big Time Rush and the incomparable Kermit the Frog. The ceremony will take place Thursday at the National Park, and the laidback, always-chill Goulding said she's just as excited about this event as she was about performing at the royal reception.

"Prince William saw me about a year earlier, and they were both really big fans of my record. It was simple as that," Goulding said casually. "I'm quite relaxed about things, probably too relaxed, and so when I found out, I was probably like, 'Cool.' "

Goulding, who performed on "Saturday Night Live" earlier this year, said she wasn't sure who recommended her for the tree-lighting gig. While it's uncertain whether President Obama had heard of her, or maybe his daughters are fans, her lead single "Lights" might have had a hand in it.

Was Lady Gaga born to be single? Even though she is reportedly dating Vampire Diaries hottie Taylor Kinney, the Grammy-winning star doesn't have faith in her romantic relationships.

"I have an inability to know what happiness feels like with a man," the Mother Monster, 25, says in the new issue of Vanity Fair. "I think what it really is, is that I date creative people. And I think that what intimidates them is not my purse, it's my mind."

Lady Gaga (born Stefani Germanotta) admits she has mastered the art of conducting a "Bad Romance."

"It starts out good," she says. "Then when I'm in these relationships with people who are also creative, or creative in their own way, what happens is the attraction is initially there and it's all unicorns and rainbows. And then they hate me."

The problem could also stem from the native New Yorker's high expectations of the perfect partner. According to England's The Sun, Gaga's turn-ons range from "a really big d*ck to a degree at Harvard," which she realizes is "a bit more difficult than a box of Milk Tray and Tesco flowers."

In the past, Gaga reveals, her romances have turned into a vehicle for heartbreak. "It's a hideous place to be in when someone that you love has convinced you that you will never be good enough for anyone," she says.

But no matter what's going on with her romantic life, Gaga says her fans are her true love: "I only know the happiness of putting a smile on someone' s face from the stage."

ABC Family Renews ?Pretty Little Liars? For Third Season

The size of the order is a whopping 24 episodes, which rivals those for broadcast drama series. It matches the mystery series’ sophomore-season order, which was consequently upped to 25 episodes with a Halloween special that aired last month. Pretty Little Liars, from Warner Horizon and Alloy, returns for the second part of its second season on Monday, January 2. The series, which broke ABC Family ratings records in several young demos when it premiered last year, has become one of the network’s top three shows, or as ABC Family’s president Michael Riley calls them, ABC Family’s “triple-threat”: Switched At Birth, The Secret Life Of The American Teenager and Pretty Little Liars.

Britney Spears Video Tournament Down To Elite 8!

'Everytime' falls out of tournament in round two, losing to 'Lucky.'

Round three is now open for voting in the Britney Spears Tournament: 30 Videos for 30 Years!

When polls closed Sunday night, we had narrowed the brackets down from the Sweet 16 to the Elite Eight, and some of the results were shocking!

Four of the eight matchups in round two of the tournament remained neck-and-neck until the moments the polls closed. After holding the advantage for most of the second round, "Everytime," which also happens to be Perez Hilton's favorite Britney Spears video, fell out of the tournament, losing to Britney's diva alter ego in "Lucky."

Two of Britney's most dance-heavy videos, "(You Drive Me) Crazy" and "Me Against the Music," were back and forth with each other for most of the round before Madonna and Britney's hit lunged forward and sent green-tube-top Britney out of the tournament with less than 1 percent more of the votes.

Round three will see "Stronger" take on "Criminal" in a pairing that many thought would be "Oops! ... I Did It Again" vs. "... Baby One More Time." Of Britney's three VMA-winning videos that remained in round two, only her most recent win, "Till the World Ends," will move forward to battle it out with "Lucky."

Round three will also see two of Britney's most iconic videos, "Toxic" and "I'm a Slave 4 U," go up against each other; only one of them will make it to the Final Four.

Round three is open for voting until Tuesday, November 29, at 11:59 p.m. The final four will be announced and open for voting on the morning of Wednesday, November 30.

Zac Efron's "The Lucky One" Featurette: Watch Now!

Offering up a glimpse at what's in store, Warner Bros. Pictures has released a new featurette for the upcoming film titled "The Lucky One".

The war-based drama stars "High School Musical" alum Zac Efron and the lovely Taylor Schilling in the lead roles - with a poster of the two sharing a close moment also hitting the web.

TV FAB: "ReDICKulous" Self-Service Act On "RHOA" Sets Off FIRE-STORM Of Controversy

Last night on episode 4 of "RHOA" Phaedra Parks presented Kandi with a HUGE birthday present in the form of ATL stripper ReDICKulous. Now we've all seen strippers on "RHOA" before....but it's a certain "self-service" act that he might have performed on stage that really set folks like Roland Martin and Kandi's momma off. Watch it inside....

You might have heard folks around the watercooler talking about "RHOA" last night.  This likely happens once a week but a few things went down last night that have some folks enraged.

First some background....Sex toy expert Kandi Burruss celebrated her 35th birthday.  So preacher's kid Phaedra Parks hired her client ReDICKulous to do a birthday set.  No biggie right?  Well....you might remember that Phaedra said last season that she knew a stripper who could give himself oral sex....well...that's him!

Now....we don't see THAT on camera....but let's assume Phaedra didn't bring him out unless he was gonna show off ALL his tricks.  Whatever did happen...it upset a lot of viewers, including Roland Martin, who tweeted:

Avril Lavigne lets her guard down on her Goodbye Lullaby single "Wish You Were Here." The poignant track is about pining away for that one person you let slip away. The emotional pull of the track, produced by Max Martin and Shellback, is the perfect tune for anyone who's not able to be with the ones they love this holiday season.

"I'm excited about 'Wish You Were Here' being the single because it's a ballad and the song kind of represents the album definitely more so than the first single," she told MTV News about the song, which she performed during the Macy's Thanksgiving Day Parade last week. "That was kind of more my older stuff and more pop rock and aggressive and a lighter subject. Goodbye Lullaby, for me, was a record that I was writing for myself."

"Wish You Were Here" and its simple, Dave Meyers-directed video really sum up the album for Lavigne. "It was more raw and stripped-down and more emotional and I wasn't holding back," she said of working on the album. "[It's] sort of more song driven and the production was mainly just like a lot of acoustic guitars and loops and just all about the vocal; the vocal being clear and having an honest emotion to it. And saying that, yeah, the first two singles ['What the Hell' and 'Smile'] were more pop rock, and so now finally with this one, 'Wish You Were Here,' being released, it feels right."

The song comes from a place deep inside and is very much about someone in Lavigne's life. "I love this song. I like this song because I wrote it about missing somebody and that's something that we all go through at some point in our lives," she explained. "It's just about looking back and remembering all those good times you shared with somebody, all the crazy moments. And that's life. We all experience that at some point, but it has a positive message."

Maggie Gyllenhaal and Peter Sarsgaard: Expecting!


Maggie Gyllenhaal and husband Peter Sarsgaard, already the parents of a five-year-old daughter, are expecting their second child together, according to reports.

Rumors swirled last month when she arrived on the red carpet premiere of her movie Hysteria at the Rome Film Festival, sporting what looked like a baby bump.

A source confirmed: "Over Thanksgiving weekend, Maggie was telling friends that she's six months pregnant. Her bump is so big! She's thrilled to be pregnant!"

Maggie and Peter got engaged in 2006 and wed in 2009.

The Gyllenhaarsgaard source adds: "She and Peter have wanted another child for a while. They're very happy that they'll have another baby in the house soon."

Jake Gyllenhaal, meanwhile, "is so happy she's pregnant again because he loves kids. Maggie's said that he's the best uncle and has done a lot of sweet things."

'The Muppets': The Reviews Are In!

Critics are overwhelmingly happy with the big-screen reboot featuring Kermit and the gang.

It's time to play the music. It's time to light the lights. It's time to meet "The Muppets" for the first time in over 10 years. Everyone's favorite felt friends are back in a big-screen reboot brought to life mostly on behalf of the hard work of lifelong Muppet fan Jason Segel.

The reviews have been overwhelmingly positive. (You can see our own rave here.) Critics have praised the return of the Muppets as fun, warm, family-friendly fare, true to the characters and the fans who have loved them for decades.

The Story
"A clever idea holds this reboot together, as simple as making one brother (Gary, played by Segel) human and the other (Walter, voiced by Peter Linz) a Muppet in love with the Muppets legacy. (He sports a Kermit wristwatch.) The locale is Smalltown, USA, which Gary and Walter introduce to us in the opening number, 'Life's a Happy Song.' Gary, his schoolteacher sweetheart Mary (Amy Adams) and Walter journey to Los Angeles for a vacation. Touring the old Muppet Studios facility, the trio learn of the plan to raze the historically significant and sentimentally priceless structure. There's oil under the ground, see, and the weaselly millionaire (Chris Cooper) after it doesn't give a Gonzo's patoot about nostalgia. To preserve the old homestead the visitors must gather together the Muppets from various locales and raise $10 million in a save-the-Muppets telethon." — Michael Phillips, The Chicago Tribune

Nicki Minaj Named Billboard's Rising Star Of 2011

'My nation of Barbz and I have come a mighty long way,' the rapper says in a statement.

Take it from Nicki Minaj: Hard work pays off. From underground mixtape artist to platinum-selling superstar, the Young Money raptress has been named Billboard's Rising Star of 2011.

Alongside Taylor Swift, who was named Billboard's Woman of the Year, the Harajuku Barbie will accept the Rising Star award at the sixth annual Women in Music event in New York on December 2.

"I am deeply honored to be recognized by Billboard," Minaj said in a statement. "My nation of Barbz and I have come a mighty long way; yet we are nowhere close to where God will take us. Sit back and enjoy the ride."

And what a ride the past year has been. Since releasing her full-length debut album, Pink Friday, in late November 2010, the hip-hop darling has broken records, released a string of hit singles and toured with pop royalty. Most recently, the rapper nabbed a pair of American Music Awards, including Favorite Rap/Hip-Hop Artist and Favorite Rap/Hip-Hop Album.

Bill Werde, Billboard's editorial director, echoed the starlet's accomplishments, saying, "Nicki Minaj has established herself as a force in hip-hop and pop music, and we're thrilled to recognize her accomplishments over the past year by honoring her as this year's Rising Star. Her unique style and powerful sound will undoubtedly lead to a long and lustrous career, and we look forward to seeing where she goes and what she does next."

Minaj follows an elite group of Rising Star recipients, including Jazmine Sullivan (2010), Lady Gaga (2009) and Colbie Caillat (2008).

Word of the MC's achievement comes just a day after she announced her sophomore effort, Pink Friday: Roman Reloaded, which is scheduled to drop on Valentine's Day. In addition to the forthcoming LP, the superstar just wrapped up filming the clip for her David Guetta collaboration "Turn Me On," which she also performed at the AMAs. " *sigh* just wrapped the video for Turn Me On.... You'll love it ;)," she tweeted early Wednesday morning (November 23).

Making for quite the adorable duo, Kylie Jenner and Cody Simpson were side-by-side in Los Angeles, CA on Sunday afternoon (November 27).

The "Keeping Up with the Kardashians" cutie was all smiles as she strolled the grounds of The Grove shopping center with the "On My Mind" singer during what appeared to be a casual date.

Kylie and Cody's Thanksgiving weekend romp came as Miss Jenner was getting ready to watch the season two premiere of sisters Kim and Kourtney Kardashian's spinoff show "Kourtney & Kim Take New York," as she tweeted during the course of the day, "So excited to watch Kourtney & Kim Take New York!!!! Kate Gosselin Kicks Off Steve Irwin Day Down Under

Down Under to kick things off, Kate Gosselin opened Steve Irwin Day at the Australia Zoo in Sydney earlier today (November 14).

Dressed in a khaki ensemble, the mom of eight was all smiles for the shutterbugs as she attended the event in honor the late crocodile hunter.

Looking to having a fabulous time, Kate tweeted, "Just finished auctioned luncheon with a bunch of amazing ladies....great company, food, and all for a great cause!! Grateful for another day here (sic)."

This is the second time Kate has visited the zoo, as she and her brood made a previous stop there back in January where they enjoyed a special performance from Irwin's widow and kids.

Red Hot Chili Peppers Debut 'Monarchy Of Roses' Video

New clip is a tribute to artist Raymond Pettibon, who helped shape the L.A. punk scene the band grew up in.

When I first interviewed the Red Hot Chili Peppers back in June, frontman Anthony Kiedis made it a point to wear his now-ubiquitous OFF! cap (the same one he'd wear in their "Adventures of Rain Dance Maggie" video), a tribute to the punk supergroup made up of members of Black Flag, Red Kross and Rocket From the Crypt, to name just a few.

The reason I mention that now is because the Peppers just premiered the video for "Monarchy of Roses," the second single from their I'm With You album, a stark, surging, (mostly) black-and-white thing very much indebted to the work of artist Raymond Pettibon, who made his mark designing album covers, logos and flyers for Black Flag, SST Records and just about anyone else associated with the L.A. punk scene of the late '70s/early '80s.

So, in a way, months before "Roses," Kiedis was already tipping his, uh, cap to Pettibon. Shoot, he even mentions the artist in the lyrics to the song, which makes the clip — directed by Marc Klasfeld — even more fitting. And when you consider the fact that the Peppers basically grew up in the scene Pettibon helped shape (they caught an early break thanks to impresario Brendan Mullen, who booked them at his infamous Club Lingerie), you realize that this video has actually been in the works for a very long time indeed.

While it might not be as flashy or instantly memorable as some of the band's other clips, it fits both the grit of the song — and the Peppers' entire legacy — perfectly. Pettibon's bludgeoning black-and-white images, which he often matches with harrowing texts taken from popular culture, art criticism and commercials, are a true combination of the sacred and the profane, and you could reasonably argue by that logic alone that they've been inspiring Kiedis' lyrics for years now.

The argument could also be made that, by sheer will alone, the Red Hot Chili Peppers have finally earned the right to be considered right alongside bands like Black Flag (and artists like Pettibon) in the pantheons of Left Coast rock, punk or otherwise. Which adds a whole new wrinkle to the "Roses" video, really: It may be their coronation, though I am reasonably sure they did not intend it to be. They're too humble. And always paying tribute, to Mullen (on the I'm With You track "Brendan's Death Song"), to their punk forefathers (Kiedis' OFF! cap) and, really, to the artist who managed to inject iconography into the whole thing.

That he did it in such a stark, shocking way was a testament to the music and the ethos of the era, and as "Roses" proves, it's a solid fit for the Peppers too. After all, like Pettibon's work, they know a thing or two about bleak times. And they've never been afraid to get a little bloody, either.

Jonah Hill Debuts Exclusive 'Sitter' Clips: Watch Now!

Sneak peeks aren't exactly a glowing endorsement for Hill's childcare skills.

Although we've seen new sides of Jonah Hill's acting abilities via more dramatic performances in "Cyrus" and this year's well-received "Moneyball," fans of his work in R-rated comedies are likely excited to see him up to his old comedic tricks in the new movie "The Sitter."

MTV News was lucky enough to have Hill stop by for an exclusive chat about the film during "MTV First: The Sitter," during which he introduced not one, but two never-before-seen clips in front of a packed audience.

In the first clip, we meet Noah Jaybird (Hill) sitting in front of the TV while a phone rings in the background. "Mom, the phone's ringing," Noah calls to his mom, his eyes never leaving the TV. "Mom, the phone's ringing — can't you hear it?"

"Noah, can't you think about somebody else besides yourself for once?" his mom responds, coming down the stairs looking ready to go out and crossing the room to answer the phone.

"No, I totally was. That's way I said the phone was ringing," Noah says as his mother picks up the phone and receives disappointing news.

"I'm not going after all," she says sadly. "The Pedulas' sitter canceled last-minute," at which point she gives her son a very pointed, pleading look, hoping he'll step in and babysit so she can go out.

"What? Are you crazy? No. I'm not going to be a babysitter. I'm an adult man," Noah counters. "Babysitting sucks. Adult men do not babysit things."

"You're wonderful with children," his mom counters — cut to Noah standing outside the Pedula home and ringing the doorbell. A smiling, lovely Mrs. Pedula (Erin Daniels) appears, wearing a low-cut shirt that the camera zooms in on, as Noah stutters to say hello without being too obvious that he is staring at her chest.

"Hi! So, Dr. Pedula, he's still alive. You guys are still together?" he asks as he enters the home, at which point the clip ends.

Clip number two is set inside the Pedula home, in the colorful bedroom of a young girl, who looks to be in the middle of playing dress-up in that she is wearing a tiara, strings of pearls and too much makeup. Noah is meeting his new charge for the first time and not trying very hard to bond with her.

"Do you like to smell pretty?" the girl asks Noah, before spraying him in the face with perfume.

"Aaah! You got it right in my mouth! Why did you do that?" Noah asks, spitting out the perfume.

"You just spit on my carpet!" the girl protests.

"You just sprayed perfume in my mouth, what's your problem?" Noah says.

"My real babysitter, Nancy, she plays with me when she babysits, does what I want her to do," the girl responds, accusatorially.

"You know what? I'm going to let you in on a little secret: I'm not a real babysitter," Noah says.

"Shocking," the girl says sarcastically.

"I'm more of a sit-on-the-couch, eat a burrito, do whatever I say or I'll kill you type of babysitter. That's my style, you understand?" Noah threatens.

"Well, I'm going to wear sparkly things, shiny things and glittery stuff to make my favorite hot nightclub, OK?" the girl says to Noah, who mocks her statement and receives another spray of perfume in the face from her as punishment.

"Aaah! Motherf ... " Noah starts to say, when he is interrupted by Mrs. Pedula.

"Is everything OK in here?" Mrs. Pedula asks.

"What's up? No, I'm just hangin' with this little angel right here," he says, pointing to the sassy little perfume-sprayer.

"Yeah, we're just chillin'," she tells her mom, which ends the scene and the clip.
